Jury awards Medtronic $57 million in patent case against AGA Medical

The California ruling deals AGA’s with Amplatzer Occluder and vascular plug product lines, which help treat some forms of heart disease. Along with the $57 million, the jury said AGA would pay Medtronic 11 percent on future sales until 2018.

MINNEAPOLIS, Minnesota –  Medtronic has won a $57 million judgment against AGA Medical for patent infringement in which AGA will also pay royalties on future sales related to a series of vascular products.

The California ruling in federal court deals AGA’s with Amplatzer Occluder and vascular plug product lines, which help treat some forms of heart disease. Along with the $57 million, the jury said AGA would pay Medtronic 11 percent on future sales until 2018. The is the first of two phases of the trial, and AGA Chief Executive Officer John Barr stated the company would “vigorously defend the case.”

Medtronic claimed that these product infringe on a pair of patents — known as as Jervis patents — that help repair holes in the heart, place stents and work with alloys that “remember” their shape (known as shape memory alloys).

AGA is in a similar suit against W.L. Gore & Associates. The trial is scheduled to begin at the end of the month.
